Participant agreement and liability waiver

Acknowledgment of risk

I understand that bicycling, including riding an e-bike, involves inherent risks of injury or death — including but not limited to falls, collisions with vehicles or pedestrians, road hazards, weather, equipment failure, and the actions of other people. I am voluntarily participating in the Gorge Rides program with full knowledge of these risks.

Eligibility attestation

I confirm that I am at least 18 years of age, that I reside in Bingen or White Salmon, Washington, and that the identification I provided is genuine and belongs to me. I understand that providing false information disqualifies me from the program and may be reported to law enforcement.

Safe operation

I agree to:

• Wear a properly fitted helmet at all times while operating the bike;
• Obey all Washington traffic laws;
• Not ride under the influence of alcohol, cannabis, or any impairing substance;
• Not modify, dismantle, or tamper with the bike or its components;
• Lock the bike using the provided lock whenever I am not with it;
• Return the bike and all accessories on the agreed return date in working condition.

Release and indemnification

To the maximum extent permitted by Washington law, I release, waive, and discharge eBike Multnomah Falls LLC, Forth Mobility, the Washington State Department of Transportation, their employees, agents, contractors, partners, and funders (collectively, "Released Parties") from any and all liability, claims, demands, or causes of action arising out of my use of program equipment or participation in program activities, EXCEPT for those arising from the Released Parties' gross negligence or willful misconduct. I agree to indemnify the Released Parties against any third-party claim arising from my acts or omissions while using program equipment.

Medical authorization

I authorize program staff to seek emergency medical care on my behalf if I am unable to consent due to injury. I am responsible for my own medical expenses; the program does not provide health insurance.

Damage and theft

I agree to report any damage, theft, or accident immediately by calling (541) 705-2438. I understand that damage caused by my negligence, abuse, or misuse may result in charges up to the deposit amount or, in cases of total loss or theft due to my failure to lock the bike, the replacement cost.

Photo and likeness

I understand that program staff may take photos at hubs and events for outreach and reporting purposes. Photos identifying me individually will only be used with my separate written permission.

Data use

I understand the program collects participation data for grant reporting and evaluation purposes. My personal information is governed by the Gorge Rides Privacy Policy. I may opt out of optional research participation at any time.

Severability and governing law

If any provision of this agreement is found unenforceable, the remainder remains in effect. This agreement is governed by Washington law.
